Public consultation is now open for the Justice Miscellaneous (Explosive Offences) Bill 2025.
The Justice Miscellaneous (Explosive Offences) Bill 2025 seeks to amend the Criminal Code Act 1924 and the Police Offences Act 1935.
Attorney-General and Minister for Justice, Guy Barnett, said the Tasmanian Government will continue to ensure Tasmania’s legislation is fit-for-purpose in 2025.
“We’re ensuring our police have the legislation they need to crack down on criminal activity in our community,” the Attorney-General said.
“This legislative proposal aims to address gaps in the current laws concerning explosive devices and substances, in particular ‘homemade’ or ‘improvised’ explosive devices.
“Through our 2030 Strong Plan for Tasmania’s Future we’re continuing to make improvements to our legislation to keep all Tasmanians safe.”
Key Provisions will include:
- New Criminal Offences: The Bill introduces new offences related to explosive devices, substances, and bomb hoaxes, with penalties ranging from fines to imprisonment;
- Enhanced Police Powers: Specific powers for the search, seizure, and disposal of explosive materials are included to protect both law enforcement and the community;
- Post-Conviction Forfeiture: Provisions for the forfeiture and disposal of explosive materials upon conviction are outlined, ensuring these dangerous items are removed from circulation; and
- Cost Recovery: The Bill allows for the recovery of costs associated with the testing, handling and disposal of explosive materials from convicted individuals.
