Submissions invited for independent review of expungement scheme

Members of the public are invited to provide submissions to an independent review of the operation of the Expungement of Historical Offences Act 2017.

The Act, which commenced on 9 April 2018, provides a scheme enabling the expungement of charges and convictions for historical homosexual and cross-dressing offences.

It allows a person charged with a historical offence to make a confidential application to the Secretary of the Department of Justice to have a relevant charge or conviction removed from their criminal record.

The review will report on the implementation of the Act and assess whether it is operating effectively and as intended.

People making submissions should indicate whether their written submission is being made in confidence, in full or in part, and the basis for the request to be treated in confidence.

The Independent Reviewers will be responsible for determining the confidentiality of any written submissions.

People making submissions are also invited to indicate whether they wish to make oral submissions to the Independent Reviewers. Oral submissions will be taken in private.

Written submissions must be received by close of business on Monday 31 August 2020.
